Medicare on a Partner Visa

Eligibility comes from having applied for the permanent 801 or 100, not from the bridging visa. An onshore applicant can therefore enrol while an earlier visa is still in effect, and an offshore applicant cannot enrol until they are living in Australia. Can you get Medicare on a partner visa?

Usually, yes, once you live in Australia. Section 3 of the Health Insurance Act 1973 (Cth) counts as an Australian resident a person who lives in Australia and meets four tests. They hold a temporary visa. They have applied for a permanent visa that has not been withdrawn or finally decided. They have not applied for a parent visa. And either they have permission to work, or their spouse, parent or child is an Australian citizen or permanent visa holder. A partner visa application includes the permanent subclass 801 or 100, which is what opens the door.

When can you enrol in Medicare after lodging an onshore partner visa?

From lodgement, provided you are living in Australia and meet the work-rights or relative test. Services Australia's operational guidance for permanent residency applicants applies it this way. You qualify if you are onshore with a visa that lets you work. If your visa does not let you work, you qualify through a partner, parent or child who lives in Australia and is an Australian citizen, a New Zealand citizen or a permanent resident. For a de facto applicant whose current visa forbids work, note that the Act itself says "spouse". Confirm your position with Services Australia. The visa you are waiting on is the partner visa subclass 820.

Does it matter that your bridging visa is not yet in effect?

No. Eligibility attaches to the permanent visa application, not to the bridging visa. The rules for when the bridging visa itself starts are on the page about your bridging visa on an onshore partner visa.

When can an offshore partner visa applicant enrol in Medicare?

While you are outside Australia with a 309 pending

No. The Act requires you to live in Australia.

While visiting Australia before the 309 is granted

Generally not as a visitor, because a visit is not living in Australia. Home Affairs' subclass 309 page says you may be eligible "depending on your circumstances", so ask Services Australia before relying on it. Visitors from a Reciprocal Health Care Agreement country get medically necessary care. As at 23 September 2026 those countries are Belgium, Finland, Ireland, Italy, Malta, the Netherlands, New Zealand, Norway, Slovenia, Sweden and the United Kingdom. Ireland and New Zealand cover public hospital care and PBS medicines only. Italy and Malta limit cover to 6 months from each arrival.

After the 309 is granted and you arrive

Yes. You hold a temporary visa with work rights, your subclass 100 application is pending, and you now live in Australia.

How do you enrol in Medicare as a partner visa applicant?

1. Wait until you are living in Australia.
2. Complete the Medicare enrolment form (MS004). Services Australia says some people can enrol online through myGov instead.
3. Attach identity (your passport, or an ImmiCard) and the Department's letter showing the partner visa application or grant.
4. If your visa does not let you work, add evidence of your relationship to your Australian sponsor.

Which Medicare card do you get while your partner visa is decided?

An interim (blue) card. Services Australia issues it to applicants for permanent residency who live in Australia. Its expiry date matches your entitlement end date. Where your record is linked to Home Affairs data, blue cards are reissued automatically while the application stays pending.

Updating Medicare when your 801 or 100 is granted

1. Home Affairs shares the grant with Services Australia through a data link, which usually updates your record automatically.
2. If it does not, contact Services Australia with your grant letter, and a full (green) card follows.

Do you need private health cover before Medicare starts on a partner visa?

The partner visa does not require it. Clause 820.6 of Schedule 2 imposes no conditions on the subclass 820, and cl 309.6 imposes only conditions 8502 and 8515 on the subclass 309. Neither is health insurance condition 8501. Cover can still matter in three gaps.

Onshore, while an earlier visa's health-insurance condition still applies

Condition 8501 requires adequate health insurance while you are in Australia. If your student or visitor visa carries it, it binds you until that visa ends. It is not among the conditions that pass to a Bridging visa A under cl 010.611(4).

Offshore, while visiting Australia with a 309 pending

A visitor visa may carry condition 8501 (cl 600.611). Home Affairs recommends health insurance if you are not eligible for Medicare, because otherwise you pay all your own health costs.

Lifetime Health Cover loading for new partner visa holders

For a new migrant, the deadline to take out hospital cover without a loading is the later of the 1 July after your 31st birthday and the first anniversary of your Medicare registration. A blue or green card counts; a reciprocal card does not. After that, privatehealth.gov.au says the loading is 2% for each year you are over 30.

What happens to your Medicare if the partner visa is refused, withdrawn or the relationship ends?

• Refused: entitlement ends, and Services Australia writes to you.
• Refused, and under review at the Administrative Review Tribunal: you are eligible while appealing. You re-enrol with the form, an ART letter dated within 12 months, a visa with permission to work, and your passport or ImmiCard.
• Withdrawn, or finally refused: the Act's test needs an application that has not been withdrawn or finally decided, so eligibility ends.
• Relationship ends before the decision: tell the Department. Services Australia receives the application's status from Home Affairs, and your eligibility follows the application.

Review deadlines are short, and advice on your own case is immigration assistance, which ss 276 and 280 of the Migration Act 1958 (Cth) restrict to registered migration agents and Australian legal practitioners.

Can your partner visa sponsor add you to their Medicare card?

Usually not while your application is pending. Services Australia's operational guidance says people with different entitlement end dates cannot be on the same card. Your blue card has an end date and your sponsor's green card does not. Once you are a permanent resident, you can share a card.

Does Medicare have a waiting period like Centrelink on a partner visa?

No. The Health Insurance Act test contains no waiting period, so you qualify once you meet it. Home Affairs warns that government payments may carry a newly arrived resident's waiting period, which is a separate rule; see Centrelink payments on a partner visa.

Medicare is a side issue next to the partner visa itself, but it rests on the same facts: an application that is valid, pending and correctly recorded. A registered migration agent or an Australian legal practitioner makes sure the application is lodged validly and kept current, so it is more likely to succeed and your Medicare entitlement is less likely to lapse along the way. No one can promise a grant.

Is a partner visa applicant eligible for Medicare?

Usually, yes, once they live in Australia. Can a 309 visa holder get Medicare?

Yes, once they are living in Australia, because the subclass 100 application made with the 309 is still pending. An applicant who is still outside Australia cannot enrol.

Can I get Medicare on a bridging visa A?

Eligibility does not come from the bridging visa. It comes from the pending application for the permanent partner visa, so an onshore applicant can enrol while an earlier visa is still in effect or after the Bridging visa A starts.

Can I put my partner on my Medicare card?

Services Australia's operational guidance says people with different entitlement end dates cannot be on the same card. A partner visa applicant usually holds a blue interim card with its own end date, so they are usually on their own card until they become a permanent resident.

Does the partner visa require private health insurance?

No. Neither the subclass 820 nor the subclass 309 carries the health insurance condition 8501. Cover can still matter while an earlier visa with condition 8501 remains in effect, or while a 309 applicant visits Australia without Medicare.
