Changing Your Name After Marriage on a Partner Visa
A partner visa applicant whose name changes after marriage gives the Department the certificate that links both names and notifies the change in ImmiAccount, or on Form 1022 if ImmiAccount cannot be used, before the visa is decided.
Nobody has to change their name after marriage in Australia, and evidence already issued in your former name stays valid once the linking document is on file. What changes is what you tell the Department, and when.

Do you have to change your name after marriage for a partner visa?
No. You do not have to change your name after marriage for a partner visa, and the law does not require anyone to change their name on marrying. If you do change it, keep the application consistent: the Department must be able to see that the person in every document is you.
How do you tell the Department about a name change on your partner visa?
Home Affairs lists a change of name, and marriage, among the changes you must report before your application is finalised. Section 104 of the Migration Act 1958 (Cth) sets that duty.
- Log in to ImmiAccount and open your partner visa application.
- Select 'Update details', then 'Notification of changes in circumstances'.
- Attach a colour scan of the document that links your old and new names.
- If you cannot use ImmiAccount, complete Form 1022 and email or post it to the office handling your application.
- If you get a new passport in the new name, select 'Change of passport details' under 'Update details' as well.
Which document links your old and new names for the partner visa?
You married in Australia and took your spouse's surname
The official marriage certificate from the state or territory registry. The NSW, Victorian and Queensland registries say you do not need to register a separate change of name, and the ceremonial certificate from the day does not count. You registered a change of name in Australia
A change-of-name certificate from an Australian registry of births, deaths and marriages. NSW says couples who married overseas must apply for an official change of name if they want their surname changed there.
You changed your name overseas
The document from the relevant overseas authority, such as a deed poll or court order, with an English translation if it is not in English. Home Affairs lists change-of-name documents "from an Australian Registry of Births, Deaths and Marriages, or the relevant overseas authority".
What happens to your partner visa when you get a new passport?
Your visa is recorded against your passport, so a new passport needs to be linked to it. Home Affairs says the quickest way is to update the passport details in ImmiAccount, and that it links the new passport within 3 business days, as at 23 September 2026. Some cases cannot be done in ImmiAccount, including a partner visa application that is not visible there. Those go through the New Passport Details web form instead, which takes up to 14 days. For applications that are in ImmiAccount, the Home Affairs ImmiAccount guide says a passport name change is updated there.
Should you change your name before or after the partner visa is granted?
There is no right answer, only different consequences:
- Before you lodge: the least to report, but documents issued in the old name need the linking document.
- While the application is open: one change notice, plus a passport update if you get a new passport.
- After the temporary visa is granted: the same notices, because the permanent application is still open.
- After the permanent visa is granted: no change notice for the application, only the passport link.
Do documents in your old name still count as partner visa evidence?
Yes. Bank statements, leases, bills and letters issued in your former name remain partner visa relationship evidence. Home Affairs asks for proof of any change of name and documents showing other names you have been known by, so the linking document is what makes the old records read as yours. Nothing has to be reissued.
Questions about changing your name on a partner visa
Does the sponsor need to notify a name change?
The duty in s 104 falls on the applicant. The sponsor's name is part of the application, though, so report the change the same way and upload the sponsor's linking document.
Can you use a double-barrelled name?
Yes. The Victorian and Queensland registries say both partners can hyphenate their family names after marrying in Australia, using the marriage certificate as proof.
Can a husband take his wife's surname?
Yes. Either spouse can take the other's family name, and the partner visa steps are the same.
Does a name change delay the partner visa?
Home Affairs publishes nothing linking a name change to processing times. A name mismatch the file does not explain can lead the Department to ask for more information, which adds time.

A name change is simple to fix and easy to miss, and an unexplained mismatch across passports, certificates and statements invites questions. An application prepared by a registered migration agent or an Australian legal practitioner is more likely to succeed, because they can check every document for name consistency and time the notifications to the stage your application is at. No adviser can promise a grant.
